Terms & Conditions
These Terms & Conditions apply to quotations and work undertaken by Paradise Projects Landscaping (Pty) Ltd (“Paradise Projects”). Acceptance of a quotation constitutes acceptance of these terms unless otherwise agreed in writing.
1. Quotations
Quotations are valid for 30 days from the date of issue unless otherwise stated.Quotations are based on the scope of work, quantities and site conditions reasonably apparent at the time of assessment. Where quantities are estimated, the final amount may be adjusted to reflect actual quantities required.Material prices are based on supplier pricing available at the time of quotation. Significant supplier price increases occurring after the quotation validity period may require adjustment before work commences.
2. Deposits and Payment
A deposit may be required to secure the project and allow materials to be ordered. The deposit amount and any progress-payment schedule will be specified in the quotation.Unless otherwise agreed, the outstanding balance is payable on completion of the contracted work.Additional work or materials approved during the project will be added to the final account or invoiced separately.Paradise Projects reserves the right to suspend work where an agreed payment has become overdue.
3. Changes to the Scope of Work
Any work requested by the client that falls outside the accepted quotation will be regarded as a variation.Where practical, the cost of a variation will be agreed before the additional work is undertaken. Minor variations may be recorded and added to the final account.Changes requested after materials have been ordered may result in additional material, transport, labour or supplier charges.
4. Site Conditions and Unforeseen Work
Landscaping work frequently involves existing ground, structures, drainage, irrigation and underground services that cannot be fully assessed before work begins.Paradise Projects will advise the client if unforeseen conditions are discovered that materially affect the work. Any additional work required as a result will be discussed with the client before proceeding wherever reasonably possible.Examples may include buried rubble, rock, roots, unsuitable soil, concealed pipes or cables, unexpected drainage conditions and defective existing installations.
5. Access and Site Facilities
The client is responsible for providing reasonable access to the property for personnel, materials and equipment for the duration of the project.Unless otherwise agreed, reasonable access to water and electricity required to carry out the work is to be provided by the client.The client should advise Paradise Projects before work begins of any known underground services, irrigation lines, electrical cables, pipes or other concealed installations.
6. Materials
Natural materials such as stone, timber, plants and aggregates may vary in colour, texture, dimensions and appearance. Such natural variation is not considered a defect.Where a specified product or plant is unavailable, Paradise Projects will consult with the client regarding a suitable alternative where substitution would materially affect the appearance or performance of the project.Unused materials specifically purchased and charged for as part of the project remain the property of the client once fully paid for.
7. Plants and Planting
Plants are living material and their continued health depends on watering, weather, soil conditions, pests, maintenance and other factors outside the control of Paradise Projects after installation.Plants will be supplied and installed in reasonable condition. Unless a specific plant establishment or maintenance agreement forms part of the quotation, Paradise Projects cannot guarantee the continued survival or performance of plants after handover.Any supplier warranty applicable to particular plants will be passed on to the client where available.8. IrrigationIrrigation systems are designed according to the conditions and water supply available at the time of installation.Paradise Projects cannot guarantee water pressure, municipal supply, borehole performance or other external water sources.Seasonal adjustment, routine maintenance, blocked emitters, damaged pipes and changes to planting remain normal maintenance responsibilities after completion unless a maintenance agreement has been made.
9. Drainage
Drainage solutions are designed to improve the management and movement of water based on observed site conditions and information reasonably available at the time of the work.Because rainfall intensity, groundwater, neighbouring properties, municipal infrastructure and concealed site conditions are outside the control of Paradise Projects, no drainage system can guarantee that flooding or water accumulation will never occur.Any specific assumptions, limitations or exclusions relating to a drainage project will be identified in the relevant quotation where appropriate.
10. Existing Structures and Installations
Paradise Projects will take reasonable care when working around existing paving, walls, irrigation, plumbing, electrical installations, pools, buildings and other structures. Paradise Projects is not responsible for defects or failures in existing installations or structures that become apparent during or following the work unless directly caused by negligence in carrying out the contracted work.
11. Programme and Delays
Estimated commencement dates and project durations are provided in good faith but may be affected by weather, supplier delays, material availability, site conditions, client-requested changes and other circumstances outside reasonable control. Where delays occur, Paradise Projects will endeavour to keep the client informed and resume or complete the work as soon as reasonably practical.
12. Workmanship
Paradise Projects will carry out the contracted work with reasonable care and skill.Any concern regarding workmanship should be reported as soon as reasonably possible after it becomes apparent so that Paradise Projects has an opportunity to inspect and, where appropriate, rectify the work. This does not cover normal wear and tear, lack of maintenance, misuse, movement or failure of existing structures, extreme weather, third-party damage or alterations made by others after completion.
13. Waste and Site Cleaning
Removal of waste, rubble, excavated material or existing garden material is included only where specified or reasonably implied by the quotation. The work area will be left reasonably clean on completion. Landscaping and construction work may temporarily cause dust, mud, noise and disturbance to surrounding areas.
14. Ownership and Use of Designs
Drawings, concepts, planting plans, specifications, renders and other design material produced by Paradise Projects remain its intellectual property unless otherwise agreed in writing. Once the associated design fees have been paid, the client may use those materials for the property for which they were prepared.
15. Photographs
Paradise Projects may photograph completed work for its portfolio, website and marketing materials, provided that photographs do not disclose personal information about the client. Clients who do not wish their completed project to be photographed or published may advise Paradise Projects in writing.
16. Cancellation
Where a client cancels an accepted project after materials have been ordered or work has commenced, the client remains responsible for work already performed, materials ordered or supplied, supplier cancellation charges and other reasonable costs already incurred for the project. Any refundable portion of a deposit will be determined after these amounts have been accounted for.
17. Acceptance
A quotation may be accepted by signing it, confirming acceptance in writing or paying the requested deposit.Acceptance confirms approval of the scope and price stated in the quotation together with these Standard Terms & Conditions and any project-specific conditions or exclusions contained in the quotation.
